Rules and Regulations - 2008


Market Location: 200 block of 1st Street SE, behind Keller’s Furniture. We will use the eastern half of this block on Tuesdays and the whole block on Saturdays.

Market Times: Tuesdays 3:00-6:00pm Saturdays 8:30-11:30 am

Market Season: Tuesdays (first Tuesday in June to 1st or 2nd Tuesday in October)
Saturdays (first Saturday in May to 1st or 2nd Saturday in October)

Market Fee: $45 for entire season, both market days.

Rules and Regulations:

1. The VENDOR’s PERMIT must be displayed during market hours. This permit is secured by paying the market fee to the market manager or market master.

2. NO EARLY SALES are allowed. No money is to change hands prior to the official start of market.

3. Official start of market is signaled by the Market Manager or Market Master each day.

4. Vendors may stay past the end of market hours, but must vacate the street by 12:30pm on Saturday and 6:30 pm on Tuesdays. The street barricades must be taken down at that time and the street returned to normal traffic patterns.

5. Items placed for sale at the market MUST be grown, raised, baked or prepared by the vendor. NO wholesale items may be offered for sale.

6. All fruits and vegetables must be stored in clean containers in trucks or on tables protected from excess exposure to flies, dust or other contamination.

7. Only one vehicle per market slot. Multiple vehicles will require payment for multiple market slots.

8. Proper withdrawal periods must be followed, as directed by manufacturer, for any produce sprayed with chemicals prior to being offered for sale. Vendors are responsible for the safe use of any chemical inputs to their products.

9. Persons selling non-food items must have an Iowa Sales Tax permit and charge appropriate tax on their sales. Vendors are responsible for their own conduct with respect to sales tax.

10. Bakery goods may be sold at market with the following exceptions: soft pies (such as custard and pumpkin) and any with cream or custard filling.

11. Baked items must be individually wrapped, but cannot be sealed according to state regulations.


12. Jams, jellies, canned vegetables and fruits may be sold at market. All must be prepared within guidelines recommended by the Iowa State Extension office.

13. All prepared products must be labeled with the name of the food, the name and phone contact information of the person who prepared the item for sale.

14. Homemade butter, raw milk and catsup may not be sold at this market for food safety reasons.

15. Meats must be processed at a locker approved for HRI. The must be pre-packaged from that locker with proper labeling and frozen and kept at a maximum of 41 degrees Fahrenheit.

16. Vendors wishing to sell cooked meat dishes, sandwiches and other similar foods must be licensed appropriately with the state of Iowa.

17. Vendors requiring electricity or other resources are responsible for securing those resources and cannot rely on the Waverly Farmers’ Market to provide them.

18. Throughways for foot traffic must be maintained.

19. All vendors are responsible for cleaning up their stall area prior to leaving market for the day.

20. Each vendor should be considerate of adjacent vendors. Vendors must avoid blocking potential customer access to other stalls and should be aware of any activities that may adversely affect those around them.

21. Children must have an adult sponsor when selling at market. Underage vendors may earn the right to maintain their own stall once they have established that they are responsible and capable of handling their own business.

22. No animals are allowed at market.

23. Vendors are encouraged to help with market setup and tear down.

24. Waverly Farmers’ Market encourages its vendors to charge fair and reasonable prices for their products. Please remember that your products have real value and that you should charge accordingly. Also, remember that there are vendors who do rely on their income from market. Drastic underselling practices are discouraged.

25. All market participants should be considerate and respectful to each other and to their clients. Waverly Farmers’ Market is a family environment. All persons should be made to feel welcome as they enter market grounds.

Enforcement:

First offense results in a warning. Second offense results in termination of the vendor’s permit for this market with no fees refunded. Terminated vendors may apply for, but are not guaranteed, reinstatement.
